Snowy Smith finally gets his comeuppance
Mary Kluk, president of the SA Jewish Board of Deputies and a court witness, was delighted at the turn of events during mid-December when on the 15th, the Durban Equality Court gave a verdict of “hate speech” against Snowy Smith, who disseminated by e-mail, “extremely offensive”, racist anti-Jewish propaganda.

Smith had told the court he was not an anti-Semite and that he was distributing what was already on the Internet and YouTube, most of it posted by “the Jews”. He cited a list of what he described as “experts”, mostly Holocaust denialists, whose work he said he had researched and established to be the truth.
Magistrate Aletta Moolman didn’t agree with Smith and issued an immediate temporary restraint order against him.
About two days later, Smith issued an urgent interdict in the High Court but it was struck off the roll by Justice Dhaya Pillay, who ordered that Smith pay legal costs of the respondents.
Smith’s original e-mail recipients included a Durban attorney, a Cape Town news editor, a Cape Town teacher and a prominent South African businessman and former high court justice. He only cared that all were Jewish and lodged complaints.
Last year Smith had threatened to sue the Board for R10m for defamation after they had lodged a complaint on behalf of the Jewish community with the Equality Court.
Kluk told SA Jewish Report she was happy at the judgment of hate speech and that that Smith’s interdict was dismissed.
“There is no place for hatred of this kind in these fragile times,” she said.
